Acceptance of Terms

By downloading or using Mohs – Rock Identifier (“Mohs” or “the App”) you agree to these Terms of Use. If you do not agree, do not use the App. Apple’s standard Licensed Application End User License Agreement also applies and is part of these Terms. The App is developed by Natalia Ortiz (“we”, “us”).

What Mohs Does

Mohs suggests what a rock, mineral, crystal or fossil may be from a photo, with the three most likely candidates and a confidence level. When it isn’t sure, it suggests simple home tests and uses your answers to re-rank the candidates. It includes species pages and a collection of your finds, stored on your device.

Identifications, Values and Safety

• Results are produced by an AI model and our catalogue. They may be incomplete or wrong, especially with poor photos, polished or treated stones and look-alikes. The confidence level is an estimate, not a guarantee.
• Values are only broad, rough ranges for typical specimens. They are not an appraisal or an offer, and a real specimen’s value depends on things a photo can’t show. Ask a qualified appraiser or gemologist before buying or selling.
• Mohs does not say whether a stone is “real” or “fake”, natural or synthetic, and makes no claims about healing or other metaphysical properties.
• Home tests (scratching, streak, vinegar, magnet) are at your own risk. Test on a hidden part of the stone, supervise children, protect your eyes and hands, and don’t test stones that may be valuable. Some minerals are toxic, radioactive or fragile: follow the safety notes on the species page, wash your hands after handling specimens and never taste them.
• Respect the law and landowners’ rights when collecting: many places, such as parks and protected areas, forbid removing rocks, minerals or fossils.

Acceptable Use

Use the App only to identify rocks, minerals and fossils, and only with photos you have the right to use. Don’t send photos of people or illegal content, try to get around the scan limits, send automated requests, or interfere with our service.

Scan Limits and Mohs Pro

Identifying a photo costs us money, so scans are limited per day:

• Free: 3 scans a day, with no account.
• Mohs Pro: up to 40 scans a day, under a fair-use limit that no normal collector reaches and that protects the service from automated or abusive use.

Limits reset every day at midnight UTC. A photo you already scanned, and the home-test follow-up on a recent scan, don’t count as a new scan. We may change these limits; if we reduce Mohs Pro’s limit, we will tell you in the App before it applies to a period you have already paid for. Searching the species pages and your collection is always free and unlimited.

Subscriptions

• Mohs Pro is offered as a monthly or yearly subscription through the Apple App Store. Prices are shown in the App before you confirm. The yearly plan may include a free trial for new subscribers.
• Payment is charged to your Apple ID when you confirm the purchase, or when the free trial ends if you started one.
• The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• You can manage or cancel it in your Apple ID settings (Settings › Apple ID › Subscriptions) or from Manage subscription in the App. Cancelling keeps Mohs Pro until the end of the period you paid for.
• If you start a paid subscription during a free trial, any unused part of the trial ends.
• Refunds are handled by Apple under its policies.

Availability of the Service

Identification needs an internet connection and our service, which relies on third-party providers. It may occasionally be unavailable or slow. If an identification fails because of us, the scan is not counted.

Your Collection

Your collection is stored only on your device (see the Privacy Policy). We cannot access, recover or restore it.

Intellectual Property

The App, its design, species pages, texts and code are owned by Natalia Ortiz and protected by copyright. You keep all rights to your photos; you allow us to process them only to identify the stone, as described in the Privacy Policy. You may not copy, modify, distribute or reverse engineer the App except as allowed by law.

Disclaimer

The App is provided “as is” and “as available”, without warranties of any kind, including the accuracy of identifications or values, to the extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, for decisions to buy, sell or value stones made on the basis of the App, for injuries or damage from home tests or collecting, or for loss of data stored on your device. Nothing in these Terms limits liability that cannot be limited by law, or rights you have as a consumer in your country.

Changes to These Terms

We may update these Terms. The date at the top shows the latest version. If a change is significant, we will let you know in the App.

Governing Law

These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer protections of your country of residence.

Al descargar o usar Mohs – Identificador de Rocas («Mohs» o «la App») aceptas estas condiciones de uso. Si no estás de acuerdo, no uses la App. También se aplica, y forma parte de estas condiciones, el contrato de licencia de usuario final estándar de Apple. La App la desarrolla Natalia Ortiz («nosotros»).

Qué hace Mohs

Mohs propone qué puede ser una roca, un mineral, un cristal o un fósil a partir de una foto, con los tres candidatos más probables y un nivel de confianza. Cuando duda, sugiere pruebas sencillas en casa y usa tus respuestas para reordenar los candidatos. Incluye fichas de especies y una colección de tus hallazgos que se guarda en tu dispositivo.

Identificaciones, valores y seguridad

• Los resultados los produce un modelo de IA junto con nuestro catálogo. Pueden ser incompletos o erróneos, sobre todo con fotos malas, piedras pulidas o tratadas y especies parecidas. El nivel de confianza es una estimación, no una garantía.
• Los valores son solo rangos amplios y orientativos para ejemplares típicos. No son una tasación ni una oferta, y el valor de un ejemplar real depende de cosas que una foto no muestra. Consulta a un tasador o gemólogo cualificado antes de comprar o vender.
• Mohs no dice si una piedra es «real» o «falsa», natural o sintética, ni hace afirmaciones sobre propiedades curativas u otras propiedades metafísicas.
• Las pruebas en casa (rayar, raya, vinagre, imán) las haces bajo tu responsabilidad. Hazlas en una parte poco visible de la piedra, vigila a los niños, protégete ojos y manos y no pruebes piedras que puedan tener valor. Algunos minerales son tóxicos, radiactivos o frágiles: sigue los avisos de seguridad de la ficha, lávate las manos después de manipular ejemplares y nunca los pruebes con la boca.
• Respeta la ley y los derechos de los propietarios al recolectar: en muchos lugares, como parques y espacios protegidos, está prohibido llevarse rocas, minerales o fósiles.

Uso aceptable

Usa la App solo para identificar rocas, minerales y fósiles, y solo con fotos que tengas derecho a usar. No envíes fotos de personas ni contenido ilegal, no intentes saltarte los límites de escaneo, no envíes peticiones automatizadas ni interfieras con nuestro servicio.

Límites de escaneo y Mohs Pro

Identificar una foto nos cuesta dinero, así que los escaneos tienen un límite diario:

• Gratis: 3 escaneos al día, sin cuenta.
• Mohs Pro: hasta 40 escaneos al día, un límite de uso razonable que ningún coleccionista normal alcanza y que protege el servicio del uso automatizado o abusivo.

Los límites se renuevan cada día a medianoche UTC. Una foto que ya escaneaste, y responder a la prueba en casa sobre un escaneo reciente, no cuentan como escaneo nuevo. Podemos cambiar estos límites; si reducimos el de Mohs Pro, te avisaremos en la App antes de que se aplique a un periodo que ya hayas pagado. Buscar en las fichas y en tu colección es siempre gratis e ilimitado.

Suscripciones

• Mohs Pro se ofrece como suscripción mensual o anual a través de la App Store de Apple. Los precios se muestran en la App antes de confirmar. El plan anual puede incluir una prueba gratuita para nuevos suscriptores.
• El pago se carga a tu Apple ID al confirmar la compra o, si empezaste una prueba gratuita, cuando esta termina.
• La suscripción se renueva automáticamente salvo que la canceles al menos 24 horas antes de que termine el periodo en curso. La renovación se cobra en las 24 horas anteriores al final del periodo.
• Puedes gestionarla o cancelarla en los ajustes de tu Apple ID (Ajustes › Apple ID › Suscripciones) o desde Gestionar suscripción en la App. Si cancelas, mantienes Mohs Pro hasta el final del periodo pagado.
• Si te suscribes de pago durante una prueba gratuita, la parte no usada de la prueba termina.
• Los reembolsos los gestiona Apple según sus políticas.

Disponibilidad del servicio

La identificación necesita conexión a internet y nuestro servicio, que depende de proveedores externos. Puede no estar disponible o ir lento en algún momento. Si una identificación falla por nuestra culpa, el escaneo no se cuenta.

Tu colección

Tu colección se guarda solo en tu dispositivo (consulta la Política de privacidad). No podemos acceder a ella, recuperarla ni restaurarla.

Propiedad intelectual

La App, su diseño, las fichas de especies, los textos y el código pertenecen a Natalia Ortiz y están protegidos por derechos de autor. Tus fotos siguen siendo tuyas; nos permites tratarlas solo para identificar la piedra, como explica la Política de privacidad. No puedes copiar, modificar, distribuir ni aplicar ingeniería inversa a la App salvo en lo que permita la ley.

Exención de garantías

La App se ofrece «tal cual» y «según disponibilidad», sin garantías de ningún tipo, tampoco sobre la exactitud de las identificaciones o los valores, en la medida en que lo permita la ley.

Limitación de responsabilidad

En la máxima medida permitida por la ley, no somos responsables de daños indirectos, de decisiones de compra, venta o valoración de piedras tomadas a partir de la App, de lesiones o daños derivados de las pruebas en casa o de la recolección, ni de la pérdida de datos guardados en tu dispositivo. Nada en estas condiciones limita la responsabilidad que la ley no permite limitar ni los derechos que tengas como consumidor en tu país.

Cambios

Podemos actualizar estas condiciones. La fecha de arriba indica la versión más reciente. Si un cambio es importante, te avisaremos en la App.

Ley aplicable

Estas condiciones se rigen por la ley española, sin perjuicio de las protecciones obligatorias para consumidores de tu país de residencia.
